Seasonal Workers...

Seasonality is only ONE factor in deciding the eligibility of an employer for the H2A and H2B programs.. We all might think we know what seasonal work is. Rather than give you my ideas, it is better to let the Department of Labor define it for us.

 

"Seasonal work must be tied to a season of the year or by an event or pattern and is of a recurring nature"

Furthermore,

"Employment is NOT seasonal if the period is unpredictable, subject to change, or is considered a vacation period for permanent employees"

Examples of seasonal work would include, "an apple harvest", "snow blowing", "lawn care", "planting pine trees", "cultivating tobacco". Other work CAN be considered Seasonal if there is a yearly pattern to the work or workload that maynecessitate an additional work force.

Examples of work that would not be considered seasonal are: "Factory production" (that remains rather constant throughout the year.). "Daily maintenance" (unless there is a seasonal pattern to the work as in a hotel that has a seasonal trade.)

Again, the seasonality is in the employer's need rather than in the work itself.

H2A visas and H2B visas can be obtained on the basis of other factors in addition to Seasonality.
