Non Ag workers...These are workers outside the agriculturatl work force who can come to the US for temporary work under the H2B work visa program. Really, the employer's work offered determines whether the workers will come under the H2A work visa program or the H2B work visa program. Some employers can qualify for either program. I'm thinking of a greenhouse production system that could be an agriculural enterprise or a non-ag business. There are a lot of people at the Department of Labor who have time to ponder these imponderables. At USAMEX Ltd we have a lot of experience working with employers who can use the H2B work visa program. This program is more challenging to use since each State is responsible for initiating the documentation. This means that we have to know the rules, the regulations and the people in all 50 States so that we can serve our clients.
