H2A
The current US program to bring foreign workers to the United States as temporary workers in agricultural enterprises. H2A workers are regulated by the Department of Labor and the rules to employ H2A workers are different from normal employment of US workers. The H2A employer must provide housing and Worker's Compensation Insurance for these H2A workers. Adverse Wage rates are to be paid as determined by each State. FICA and State Unemployment taxes are NOT to be paid by the H2A worker or on behalf of the H2A worker.. These are the main diffences in using H2A workers by the H2A employer.

H2B

The current US program to bring workers to the United States as temporary workers in NON-Agricultural enterprises. H2B workers are treated much the same as normal US workers. Federal and State taxes are computed in the same manner for these H2B workers. Prevailing Wages for each H2B worker or group of H2B workers are determined for each job title and description by the Department of Labor.

Eligible US Worker


A US Citizen, US Resident or other person who can show proof of authority to work in the US. The documents needed for eligible US workers are found in the employment form I-9 which describes the acceptable documents needed to work in the USA. Both H2A workers and H2B workers should have an I-9 form on file.

Seasonal Labor

Labor is performed on a seasonal basis, where, ordinarily, the employment pertains to or is of the kind exclusively performed at certain seasons or periods of the year and which, from its nature, may not be continuous or carried on throughout the year. A worker who moves from one seasonal activity to another, while employed in agriculture or performing agricultural labor, is employed on a seasonal basis even though he may continue to be employed during a major portion of the year.

Temporary Labor

A worker is employed on ``other temporary basis'' where he is employed for a limited time only or his performance is contemplated for a particular piece of work, usually of short duration. Generally, employment, which is contemplated to continue indefinitely, is not temporary.
