H2B Visas

H2B visas are used by employers to employ skilled or unskilled foreign workers in seasonal or temporary non-agricultural jobs when qualified U.S. workers aren't available. To obtain H2B visas, the employer shows that the need is temporary, and that no US workers will be affected by the employment of the foreign worker.

The need may be:

•  A recurring seasonal need
•  A "Peakload" need
•  An "Intermittent" need or
•  A "One time" need

Time limits

The H2B visa will cover the temporary need but no more than one year. The US Department of Labor is reluctant to certify an employer for H2B visas for more than 10 months. While time extensions up to 3 years can be obtained for the worker who accepts an H2B visa, the employer, normally, will not be certified for the same job title and job description for more than 10 months each year.

In practice, most employers with "recurring seasonal" labor needs discover that it is best for all concerned that the H2B workers return home each year.
